ONESPACE.ID TERMS OF SERVICE
(USER TERMS OF SERVICE)
If you browse or otherwise access any content or data on the ONESPACE.ID platform (including its website, mobile site or application), you agree to be bound by these Terms of Use.
ONESPACE is a technology platform that functions to connect Virtual Office Service Provider (PROVIDER) and the types of services provided (SERVICE) with the community of prospective Virtual Office service users (USER). ONESPACE and USER will collectively be referred to as (the PARTIES).
These Terms of Service and our Privacy Policy form the basis upon which you can access and use our platform, including the website, any subdomains of that website, mobile site, applications, APIs and widgets (together will be referred to as "OUR PLATFORM" in this provision).
We reserve the right to change all or any of our Terms of Service or other terms for using our platform at any time by publishing new terms or conditions on our website.
Your use of our platform constitutes your acceptance of these terms.
The cooperative relationship between PROVIDER and ONESPACE is further stipulated in the ONESPACE SERVICE COOPERATION AGREEMENT:
1. ENFORCEABILITY
These Terms of Use govern your use of the ONESPACE.ID (ONESPACE) site and become a legally binding AGREEMENT between you and Onespace regarding the use of the site. IF YOU DO NOT AGREE TO THE TERMS OF SERVICE, DO NOT DOWNLOAD, INSTALL, COPY, USE, OR ACCESS THE WIDGET. YOUR DOWNLOAD, INSTALLATION, COPYING, USE OF, OR ACCESSING THE WIDGET CONSTITUTES YOUR ACCEPTANCE OF THESE TERMS OF USE.
The ONESPACE.ID (SITE) page includes the meaning of Sites that are updated in the future, for example sites that have gone through a co-branded process, affiliate sites, personal sites, or other international sites where ONESPACE participates in the future related to advertising services .
In the event of a breach of our AGREEMENT, reserve the right to seek all remedies offered by law and equity for such breach, including but not limited to terminating your use of the Site.
2. ONESPACE PAGE USERS
ONESPACE is a technology platform owned and operated by PT. Harta Tahta Usaha. Services and information supporting services contained in ONESPACE are obtained and provided by the Service User (USER). ONESPACE can provide additional technical support; marketing; or other matters related to the services provided by the USER.
USER is prohibited from modifying, re-displaying or redistributing any content related to the PROVIDER and the SERVICE provided.
3. CONTENT REQUIREMENTS
In order to guarantee the quality of ONESPACE services, you agree that all information you provide to ONESPACE, whether online or offline, is complete and accurate. The PROVIDER is responsible for preparing and delivering advertisements for the services offered, and shall be responsible for ensuring that the advertisements are accurate and comply with all applicable laws.
The USER is obliged to fill in personal data, address, and contact number according to those registered by the competent authority.
4. PROVIDER STATUS
There are 2 (two) types of PROVIDER on the ONESPACE, namely Verified and Non-Verified.
1) Verified Provider (VERIFIED) is a provider that cooperates with ONESPACE. The information is obtained from the PROVIDER and/or based on ONESPACE's direct observation at the PROVIDER's location.
2) Non-Verified Provider (NON VERIFIED) is a PROVIDER that does not cooperate with ONESPACE. The information is obtained from public sources. ONESPACE is not responsible for the accuracy of the information.
5. SERVICE PROVIDER
1) PROVIDER provides details of virtual office services (SERVICES) provided through ONESPACE.
2) The services listed by VERIFIED on ONESPACE are based on information provided by VERIFIED PROVIDER to ONESPACE. Changes in the details of the SERVICE are subject to change at any time.
3) The services listed in NON-VERIFIED are based on information available in public sources. ONESPACE is not responsible for changes to the details of the SERVICE.
6. LIMITS OF LIABILITY
Certain rights and remedies may be available under Indonesian consumer protection law and may not be permitted to be excluded, restricted or modified. Apart from those rights and certain remedies which cannot be excluded, to the extent permitted by law, our liability for breach of any implied warranty or condition which cannot be excluded is limited, at our option to: re-providing the service or payment of fees for re-providing services; or replacement or repair of items or payment of replacement or repair costs.
IN ANY CASE, ONESPACE IS NOT LIABLE TO THE USER OR ANY THIRD PARTY FOR ANY INDIRECT, CONSEQUENTIAL, EXAMPLE, INCIDENTAL, SPECIAL OR PUNNING DAMAGES, INCLUDING LOSS OF PROFIT, LOSS, LOSS, LOSS, LOSS WHETHER THE TIME OF STOPPING, LOSS OF PROFIT, LOSS OF OR DAMAGE TO REPUTATION, LOSS BASED ON OR RELATED TO ANY OTHER CONTRACT, LOSS OF DATA, LOSS OF USE OF DATA, LOSS OF SAVINGS OR ANY OTHER CONTRACT, LOSS OF DATA, LOSS OF USE OF DATA, LOSS OF SAVINGS OR OTHERWISE AVAILABLE OR BENEFITS THAT HAVE BEEN AVOID NEVER RELATED TO THIS AGREEMENT OR THE SITE. Whilst THERE ARE ANY CONDITIONS TO THE OPTION OF THESE TERMS OF USE, THE ENTIRE RESPONSIBILITY OF THE COMPANY AND ITS RELATED ENTITIES TO YOU FOR ANY CAUSE OF ACTION AND WITHOUT CONSIDERATION OF THE FORM.
7. INDEMNITY
You agree to indemnify and hold harmless the Company and its affiliates (directors and employees) against any and all losses, liabilities, claims or demands (including reasonable attorneys' fees) arising out of, or in connection with the use of and access to our platform by the USER or create MATERIAL that does not comply with the USER TERMS.
8. TRADEMARKS
The term “onespace.id” and any other patents such as trade names, logos, and service marks (BRAND) displayed on the Site are the property of ONESPACE. USER is not permitted to copy or use the Marks without ONESPACE's prior written consent.
9. UNAUTHORIZED DUPLICATION
Unless otherwise specified, no content on our Site may be modified; copied; reproduced; distributed; published; downloaded; displayed; for sale; compiled; installed; or transmitted in any form or by any means, including but not limited to, electronically; mechanical; photocopy; recordings or other forms of documentation without the prior written permission of ONESPACE.
10. UNLAWFUL USE
The USER agrees to comply with all statutory provisions; procedures; and regulations that apply to using our services and all activities related to those services. The unlawful acts as intended, including but not limited to:
a) violate the intellectual property rights of any third party, and you agree to pay any royalties, fees or other monies due for any Contributions you make;
b) misleading or deceptive;
c) materially incorrect;
d) likely to cause a violation;
e) directly or indirectly involves the advertising or marketing of a product or service;
f) obscene, including material that contains pornographic, hateful, racially or ethnically offensive material
g) damage the good name;
h) in any other way unlawful or encouraging unlawful acts; or
i) otherwise unsuitable for the purpose of ONESPACE.
11. FORCE MAJEURE
1) In the event of force majeure which results in non-performance of obligations or delays in the implementation of obligations based on these USER PROVISIONS, the PARTIES hereby agree that the party who does not carry out the obligations or is late in carrying out the obligations is exempted from claims for the losses of the other party caused by the non-compliance. or delay in the performance of these obligations.
2) Force majeure includes but is not limited to: a) natural disasters such as earthquakes, volcanic eruptions, storms, hurricanes, tsunamis, major floods, landslides and fires; b) massive circumstances such as wars, riots, rebellions and epidemic
12. GOVERNING LAW
1) The USER agrees to submit to the applicable laws in the Unitary State of the Republic of Indonesia.
2) In order there are disputes arise regarding the implementation and/or translation of the USER TERMS, the USER agrees to settle the dispute at the South Jakarta District Court.
